A trucking expert showcased how the driver was not following CDL guidelines when he hit the plaintiff’s vehicle. A neurosurgeon testified the injury would affect the plaintiff for the rest of his life. As a result, Muchnick Haber Margolis won a unanimous verdict that was thirty times what the trucking company suggested at trial.

Two years later, she was involved in another collision with an employee of a local brewery. We filed lawsuits against the drivers and their employers for our client’s injured neck and back. After years of litigation, we were able to settle the case for almost $1.4 million.

The trucking company spent years blaming the victim for speeding and not paying attention while its driver was making a turn. It also claimed she was not injured because she did not have any broken bones or visible injuries. We hired an expert and used drone footage to show the truck driver did not make a proper turn. Numerous medical experts were also used to establish our client suffered from Complex Regional Pain Syndrome (CRPS), a rare disorder in which pain is out of proportion to the injury.

Margolis fought against the trucking company’s defense claiming that she had been speeding and found them liable for failing to properly vet their trucker drivers. The case settled shortly before trial after four years of litigation. Despite the insurance company’s initial position that it would not pay a substantial amount of money to settle the case, it ultimately offered the full one million dollar policy limit of the trucking company insurance policy.
