Trucking Accidents

In 2018, Josh helped a Springfield woman obtain the $1 million insurance policy limits in a highly-contested tractor-trailer case. The trucking company spent years blaming the victim for speeding and not paying attention while its driver was making a turn. It also claimed she was not injured because she did not have any broken bones or visible injuries. We hired an expert and used drone footage to show the truck driver did not make a proper turn. Numerous medical experts were also used to establish our client suffered from Complex Regional Pain Syndrome (CRPS), a rare disorder in which pain is out of proportion to the injury.

We represented a client who struck the rear of a tractor trailer after it was improperly stopped on an interstate highway.  The client suffered severe injuries to his arm.  Although an argument was made that our client was at fault for the collision, we were able to obtain a significant settlement.

Josh represented a severely injured woman and helped her receive a $1 million settlement for her injuries in a trucking accident. The plaintiff had no visible injuries, but as the use of her arm deteriorated, she was diagnosed with Complex Regional Pain Syndrome (CRPS). Margolis fought against the trucking company’s defense claiming that she had been speeding and found them liable for failing to properly vet their trucker drivers. The case settled shortly before trial after four years of litigation. Despite the insurance company’s initial position that it would not pay a substantial amount of money to settle the case, it ultimately offered the full one million dollar policy limit of the trucking company insurance policy.

Construction Site Accidents

A sprinkler fitter fell from the ground level to the elevator pit at a construction site after a worker from another company altered the railing and toeboard on the open elevator shaft.  We sued the worker and company that were responsible for the negligent alteration of the job site. After extensive litigation, our client won a $700,000 settlement for her serious back injuries.

Head Injury

Todd Muchnick and Aaron Haber obtained a $650,000 verdict in federal court for a plaintiff who suffered orthopedic and psychological injuries from a car accident. The plaintiff suffered a fractured neck which resulted in a radiculopathy requiring an anterior cervical fusion. The plaintiff also suffered a rotator cuff injury which required surgical intervention. As a result of the seriousness of the accident, the plaintiff suffered from Post Traumatic Stress Disorder which rendered him unable to work.
