Saint Louis MLS Stadium: A Construction Injury Example

Construction sites require extensive adherence to safety regulations, otherwise the workers may face severe injuries or even death. Muchnick Haber Margolis often tackles construction site injury cases and, recently, a worksite injury comparable to those we handle struck the headlines for the Major League Soccer (MLS) team. Severe injuries occurred during the construction of the St. Louis MLS Stadium, leaving the door open for litigation.

The Incident at the St. Louis MLS Stadium

Construction for the St. Louis MLS Stadium has been underway for two years, and it is slated to open its doors this July. During construction a few weeks ago, a stack of drywall fell on one of the construction workers — resulting in a trip to the hospital for serious injuries. This example is just one of many dangerous incidents that occur on worksites that can cost workers their ability to work or even their lives.

While our team did not personally handle this case, worksite injuries are a type of case the injury lawyers at MHM handle often. For example, we handled a similar case to the St. Louis MLS stadium incident in which a construction worker in Columbia, Missouri, suffered a broken leg after nearly 2,000 pounds of drywall fell on her after it was stacked vertically by a company that was not her employer.

Construction injury cases, like the St. Louis MLS Stadium incident, typically fall into two categories: workers’ compensation and third-party cases. Worker’s compensation claims are filed against employers when workers are injured on the job and seek coverage for lost wages, medical treatment and disability payments.

While the negligence of an employer does not impact a workers’ compensation case, negligence involving another entity on a jobsite may qualify as a personal injury, for which a victim can file a civil suit against those who have caused harm. This type of negligence often causes a variety of injuries, including sprains, strains, burns and broken bones. These “third-party” cases occur outside of the workers’ compensation system and provide injured workers with more sources of recovery than a regular workers’ compensation case.

In 2019 alone, 5,333 workers died on the job and 20% of those workers were in construction.

There is a pressing need to fight for those risking their lives at the worksite and hold those in charge accountable. Our attorneys are well-versed in representing worksite injury cases similar to what occurred at the St. Louis MLS Stadium construction site.
